This website, mobile applications, and related services (collectively, the “Platform”) are owned and operated by Founder Stream Pty Ltd (“Founder Stream”, “we”, “us” or “our”).
By accessing, browsing, or using this Platform, you (“you”, “your”, or “user”) agree to be bound by these Terms of Use (“Terms”) as well as any other policies, notices, or guidelines published on the Platform and as amended from time to time. Please read these Terms carefully before using the Platform. If you do not agree to these Terms, please immediately discontinue your use of the Platform.
Founder Stream reserves the right to amend these Terms at any time without prior notice. Amendments will be effective immediately upon posting on the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms.
All Users of the Platform
These Terms apply to all users of the Platform, including but not limited to visitors, account holders, subscribers, and content creators.By using or visiting the Platform, you affirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are under 18 years old, you must have the consent of a parent or guardian, and you must not create an account or use any monetisation features.
Account Registration & Security
To access certain features of the Platform, you must register an account (“User Account”) by providing accurate, complete, and up-to-date information. You are responsible for safeguarding your account credentials and for all activities conducted through your User Account.
You agree to notify Founder Stream immediately of any unauthorized use or security breach related to your User Account via legal@founderstream.live.You must not share your login details or allow others to use your account without our express permission.
Use of the Platform
Founder Stream is a digital platform enabling founders to share and stream original content, monetise via tips, subscriptions, and crowdfunding, and connect with audiences, partners, and investors.You agree to use the Platform lawfully and not to:Upload content that is unlawful, defamatory, obscene, infringing intellectual property rights, or otherwise harmful.Impersonate others or misrepresent your affiliation.Upload viruses, malicious code, spam, or engage in disruptive activities.Circumvent any access controls or usage limits.Engage in any conduct that interferes with the proper functioning of the Platform or other users’ enjoyment.Founder Stream reserves the right to remove content or suspend accounts violating these Terms.
User Content & Intellectual Property
You retain ownership of all content you upload (“User Content”).By uploading User Content, you grant Founder Stream a worldwide, non-exclusive, royalty-free, transferable license to host, display, stream, distribute, and promote your content on the Platform and in related marketing materials.You warrant that you have all necessary rights and permissions for any content you upload.All non-user content on the Platform, including design, branding, software, and trademarks, is owned by Founder Stream or its licensors. You may not copy, reproduce, or create derivative works without our written consent.
Monetisation, Payments & Fees
Payments for subscriptions, tips, and crowdfunding campaigns on the Platform are processed via third-party providers such as Stripe and PayPal.
Founder Stream deducts a 10% service fee from all transactions.
You are responsible for any taxes or fees related to your earnings.
Payouts are made monthly once your balance reaches a minimum threshold of US $100.
Privacy
Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to the terms described in the Privacy Policy.
Termination
Founder Stream may suspend or terminate your User Account or access to the Platform if you:Violate these Terms or applicable laws.Engage in conduct that risks harm to Founder Stream, its users, or its reputation.You may terminate your account at any time through your account settings.
Disclaimers
The Platform is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service.Founder Stream is not responsible for the actions, content, or conduct of other users.
Limitation of Liability
To the maximum extent permitted by law, Founder Stream, its affiliates, and licensors shall not be liable for any indirect, incidental, consequential, or punitive damages.
Our total liability arising from your use of the Platform will not exceed the greater of US $100 or the fees you have paid to us in the prior 12 months.
Indemnification
You agree to indemnify and hold harmless Founder Stream, its affiliates, employees, and agents from any claims, damages, or expenses arising from:Your User Content.Your use of the Platform.Your violation of these Terms.
Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or notice on the Platform. Continued use after such updates constitutes acceptance.
Governing Law & Dispute Resolution
These Terms are governed by the laws of Victoria, Australia. Disputes will first be attempted to be resolved informally. If unresolved, disputes shall be subject to binding arbitration or the courts of Victoria.
