Terms and Conditions
Welcome to Founder Stream (“we,” “our,” “us”). By accessing or using the Founder Stream website, mobile applications, and related services (collectively, the “Platform”), you (“you,” “your,” “user”) agree to be bound by these Terms & Conditions (“Terms”). Please read them carefully.
If you do not agree to these Terms, you must not use the Platform.
1. Eligibility
You must be at least 18 years old to use the Platform.
By creating an account, you confirm that you have the legal capacity to enter into these Terms.
2. Account Registration & Security
You must provide accurate and complete information during signup. You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at [legal@founderstream.live] if you suspect any unauthorized use of your account.
3. Platform Purpose
Founder Stream is a digital platform that enables founders to: Share and stream original content. Monetize their content via tips, subscriptions, and crowdfunding. Connect with audiences, partners, and investors. We are a hosting service, not a publisher, and do not pre-screen user content.
4. User Content & Rights
You retain ownership of the content you upload (“User Content”). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to host, display, stream, distribute, and promote your content on the Platform and in marketing materials. You confirm you have all rights and permissions necessary for any content you upload.
5. Prohibited Content & Conduct You agree not to: Upload content that is unlawful, defamatory, obscene, infringing, or otherwise harmful. Impersonate another person or misrepresent your affiliation. Upload spam, malicious code, or engage in activity that could harm the Platform. Circumvent any access or usage limits. We reserve the right to remove any content or suspend accounts that violate these Terms.
6. Monetization, Payments & Fees
Payments for subscriptions, tips, and crowdfunding are processed by third-party providers (e.g., Stripe, PayPal). Founder Stream will deduct a 10% platform service fee from each transaction. You are responsible for any applicable taxes on your earnings. Payouts on Founder earnings are made on a monthly basis when the account reaches a minimum threshold of US $100.
7. Intellectual Property
All non-user content, including site design, branding, code, and features, is owned by Founder Stream or its licensors. You may not reproduce, distribute, or create derivative works from our materials without written consent.
8. Privacy
Your use of the Platform is also governed by our [Privacy Policy]. By using the Platform, you consent to the collection and use of your information as described there.
9. Termination
We may suspend or terminate your account if: You violate these Terms or applicable laws. You engage in activity that risks harm to us, our users, or our reputation.
You may terminate your account at any time via your account settings.
10. Disclaimers
The Platform is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service. We are not responsible for the actions or content of other users.
11. Limitation of Liability
To the maximum extent permitted by law: We are not liable for indirect, incidental, or consequential damages. Our total liability to you for any claim will not exceed the greater of:
(a) $100 USD, or
(b) the total fees you have paid to us in the 12 months prior to the claim.
12. Indemnification
You agree to indemnify and hold harmless Founder Stream, its affiliates, and employees from any claims arising from: Your content. Your use of the Platform. Your violation of these Terms.
13. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or a notice on the Platform. Continued use after changes means you accept the updated Terms.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of Victoria, Australia. Disputes will first be attempted to be resolved informally. If unresolved, disputes will be subject to binding arbitration or the courts of Victoria, Australia.
